'Cutting in' and sudden lane changes within rest areas: Diverging judgments on negligence ratios

A heated debate broke out among the cast regarding the negligence ratio of an accident between vehicles that occurred in a parking space and a lane within a rest area. In the JTBC 'Han Moonchul's Dashcam Review' broadcast, the driver's duty of care and accident liability were addressed through two dashcam videos that occurred within a rest area.

'Cutting in' attempts to overtake the car ahead and accident liability

The first video captures an accident that occurred during the process of entering a rest area. The situation in the video shows a scene where, while the car ahead was moving to park, the car behind attempted a so-called 'cutting in' maneuver, seemingly trying to overtake the car ahead, which led to an accident. Regarding the situation in the video, the cast mentioned, "It's a kind of cutting in line. It's cutting in," pointing out the danger of the following car, which entered recklessly while expecting the car ahead to stop.

Opinions among the cast diverged regarding the proportion of negligence for the accident. One cast member emphasized the duty of care, stating, "You should have looked at the car coming out," noting that the driver failed to properly observe the situation of the car ahead emerging. Meanwhile, there was an opinion analyzing that, depending on the situation in the video, there is "a possibility that about 20% will definitely be recognized" for the dashcam vehicle (the car ahead) as well. The cast repeatedly emphasized that since a rest area is a place where cars can come out at any time, one must drive slowly while looking left and right.

Sudden lane changes without turn signals: Is it a parking lot or a road?

The following video dealt with an accident caused by a vehicle moving to the right for parking suddenly changing lanes to the left without turning on its direction signal (turn signal). Regarding the nature of the location, the cast was divided, with opinions such as "It is strictly a parking lot" clashing with "This is a road. It's a street here."

'Failure to use turn signals' was identified as the direct cause of the accident. The cast made it clear that even if a vehicle is moving to park, it must use turn signals to provide a signal to surrounding vehicles. In particular, regarding the situation where a vehicle moving to the right turned left without warning, they mentioned the danger, saying, "It looks like they didn't even turn on the signal." In response, an analysis followed that "If they had turned on the left signal, the car behind would have had to wait a bit longer."

The cast agreed that in spaces like rest areas where vehicles and pedestrians move closely together, unpredictable situations can occur at any time, so a more careful driving attitude than usual is required.
